The following privacy policy (“Privacy Policy”) is provided by U.S. Energy Development Corporation and its affiliates (collectively, “U.S. Energy”, “we” or “our”). This Privacy Policy applies to personal information that we collect about visitors to websites and other online services of U.S. Energy. This Privacy Policy describes the collection, use and sharing of personal information. As used in this Privacy Policy, “personal information” means, unless the context requires otherwise, information, either on its own or with other information, about an individual that is collected or maintained for business purposes and by which such individual can be identified.

What personal information do we collect from people who visit our website, blog, or other online services?

The types of personal information we collect and share about you depends upon which service or product you elect, or how you engage with U.S. Energy. For example, personal information which we may collect includes: your name, email address, mailing address, phone number, social security number, date of birth, personal identifiers and other information collected through your use of our website or electronic platforms.

When do we collect information?

You provide personal information to us when you subscribe to a U.S. Energy newsletter, respond to a survey, fill out a form, request information or otherwise interact with U.S. Energy. Additionally, we may receive information about you from parties that you authorize to provide us with such information and from publicly available sources.

How do we use and disclose your information?

We may use the information we collect from you to service and protect your account, process transactions, respond to inquiries from you, develop and deliver products and services, manage our business and fulfill regulatory and legal requirements; below are additional business purposes for which we collect such information:

• To personalize and enhance your user experience.
• To improve our website in order to better serve you and deliver the type of content and product offerings in which you are most interested.
• To allow us to better service you in responding to your customer service requests.
• To administer a contest, promotion, survey or other site feature.
• To quickly process your transactions.
• To verify your identity and protect against fraudulent or illegal activity.
• To provide education.
• To send periodic emails regarding other products and services.
• Vendors may occasionally be sent your investor information for the purpose of facilitating the transfer of your monthly investment performance for viewing through the U.S. Energy web portal. This may include, but is not limited to, information related to your fund, investment, performance, personal identifiable information and tax documentation.
• In certain instances, we contract with service providers to perform services for us that require certain information; where necessary, we may disclose personal information we have about you, or you may provide personal information to such service provider directly. In such cases, only the amount of information deemed necessary for a service provider to carry out their responsibilities is provided.
• For our legitimate interest or those of a third party. For these purposes, a legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own legal rights and interests.
• To comply with legal process, regulatory and legal requirements and in other legally limited circumstances.

How do we protect your information?

We maintain technical, administrative and organizational measures designed to protect personal information and such measures are adapted to respond to changing circumstances and technological advances. Our website and online services are scanned on a regular basis for security holes and known vulnerabilities.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, who need to know the information to perform their job duties and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. For your convenience we may store your financial and/or credit card information longer than 30 days to expedite future orders, and to automate the billing process.

Do we use ‘cookies’?

We and our third-party service providers utilize cookies. A cookie is a small block of data that is stored on your device when you visit a website or a mobile application and allow websites and mobile applications to recognize devices and store certain information. Cookies are used to distinguish you from other users of our online services and help us personalize your user experience and offer you services that you may find beneficial. We and our service providers utilize session cookies, which expire at the end of online sessions, as well as persistent cookies which remain on your device and allow us to retain your preferences across multiple online sessions. We and our third-party service providers may collect a variety of technical information about you, including, but not limited to: your computer or device type, browser type and version, user agent string, internet connection type, date and time of your visit, time since your last visit, pages you view, links you select, searches you conduct, the internet protocol address used to access our website, your general geographic location, and the website visited before our site.

If you are concerned about cookies, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You can also delete cookies from your device. You can do this through your browser (e.g., Internet Explorer) settings. Each browser is different, so look at your browser’s help menu to learn the correct way to modify your privacy settings.

However, if you delete or disable cookies, some features of our website or other online services that make your experience more efficient will be disabled and some of our services will not function properly.

Web Beacons

Our website, online services and emails that you receive from us utilize web beacons. A web beacon is an electronic file that is typically invisible and is used to provide us with analytics for our website and online services. In certain cases, a web beacon may place a cookie on the device used to access the online resource.  Web beacons allow us to determine when you receive emails, whether you open those emails, and if you click on any hyperlink therein. These are not used to collect data in cookies that have been created by other websites.

Analytics

We utilize service providers to collect information identified herein to engage in analysis, auditing reporting and research. These service providers may utilize cookies or web beacons to collect information about your activity on our website or other online services. The information generated about your use of the website or other online services may be transmitted to and stored on servers outside of your State of residence.

Interest-Based Advertising

We engage service providers to provide programmatic advertising services that are customized based on your online activities and activities across unrelated websites and over time. Such service providers may use cookies, web beacons and similar technologies to collect information about you and your activities on unrelated websites. We and our service providers may use data collected about you to provide U.S. Energy adds to you as you browse the internet. For example, your email address may be shared with an advertising partner so that they can target ads for U.S. Energy products and services to you on non-U.S. Energy websites.

Third Party Disclosure

We do not sell, trade, or otherwise transfer your personal information to non-related third parties for use in marketing their products or services. Similar to many businesses, we disclose personal information, including in certain cases, sensitive personal information, to third parties for business purposes. See “How do we use and disclose your information” above for third parties with which personal information may be shared. Dependent upon your relationship with U.S. Energy, the type of information disclosed may differ.

Third Party Links

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third-party websites have separate and independent privacy policies. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites. Please consult the privacy policy and opt-out provisions for each third-party link that you engage.

Our website may allow you to share information directly with websites operated by third parties (e.g., LinkedIn, Instagram and Vimeo). If you choose to use these features, you may disclose information to those websites or services and their users, and to the public more generally. Even if you do not utilize these features, these third parties may collect information about you and set or access cookies on your device.  This Privacy Policy does not address the privacy, security, cookie policy or other practices of the provider of any third-party website; we therefore have no responsibility or liability for the content and activities of third-party websites.

California Online Privacy Protection Act

The California Online Privacy Protection Act (“CalOPPA”) requires operators of commercial websites who collect personally identifiable information about California residents to conspicuously post its privacy policy on its website which states, among other things, the personal identifiable information being collected and whom it is being shared. To the extent that CalOPPA applies, we agree to the following:

• Users can visit our website or other online services anonymously.
• This Privacy Policy shall be included on U.S. Energy’s home page, or as a minimum on the first significant page after entering our website.
• Users may review and request changes to their personally identifiable information by emailing such request to privacy@usedc.com.
• We may update this Privacy Policy from time to time. Any updates to this Privacy Policy will be reflected in the privacy policy that is included on our website.
• We honor do not track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

California Privacy Rights Act of 2020

This section of the Privacy Policy is provided to address the California Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, as amended (collectively, the “CCPA”), and applies solely to personal information and U.S. Energy to the extent that they are subject to the CCPA. As used in this section, a “consumer” is a natural person resident of the State of California and a “covered business” means a business that is subject to the CCPA. Set forth below is a description of rights that California residents generally have under the CCPA, which are subject to certain exceptions:

Right to Know: A consumer has the right to request that a covered business that collects a consumer’s personal information disclose certain information collected and the category of information. A consumer may also request that a covered business disclose:

• The categories of personal information collected.
• Specific pieces of personal information collected.
• The categories of sources from which the covered business collected personal information.
• The purposes for which the covered business uses the personal information.
• The categories of third parties with whom the covered business shares the personal information.
• The categories of information that the covered business sells or discloses to third parties.

Right to Delete: A consumer may request that a covered business delete personal information they collected from such consumer and tell their service providers to do the same, subject to certain exceptions.

Right to Opt-Out of Sale or Sharing: A consumer may request that a covered businesses stop selling or sharing such consumer’s personal information (“opt-out”), including via a user-enabled global privacy control. Covered businesses cannot sell or share a consumer’s personal information after they receive such consumer’s opt-out request unless such consumer later authorizes them to do so again.

Right to Correct: A consumer may ask a covered businesses to correct inaccurate information that they have about such consumer.

Right to Limited Use and Disclosure of Sensitive Personal information: A consumer may direct a covered business to only use such consumer’s sensitive personal information for limited purposes, such as providing such consumer with the services it requested.

Right to Non-Discrimination: A consumer has the right to non-discrimination for exercising its CCPA rights.

Children’s Online Privacy Protection Act  

When it comes to the collection of personal information from children under 13 years of age, the Children’s Online Privacy Protection Act (“COPPA”) puts parents in control. The Federal Trade Commission enforces the COPPA, which identifies what operators of websites and online services must do to protect children’s privacy and safety online.

We do not specifically market to children under 13 years of age; we do not intentionally collect information from those who we know are under 13 years of age and we request that these individuals do not provide personal information.
